OVERVIEW

Welcome to Anna’s Floral Designs (“Anna’s Floral Designs,” “we,” “us,” or “our”). We operate this website and online store, along with related information, content, features, tools, products, and services (the “Services”) to provide you with a curated shopping experience. Our store is powered by Shopify, which enables us to provide the Services.

These Terms of Service (the “Terms”), together with any policies referenced here, describe your rights and responsibilities when using the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. ACCESS AND ACCOUNT

You represent that you are at least the age of majority in your state or province of residence and have authority to agree to these Terms. You may be asked to provide information (name, email, billing, payment, and shipping details). You warrant that all information provided is accurate, current, and complete, and that you have rights to provide it. You are responsible for maintaining the confidentiality of your account credentials and for all activity on your account.

2. OUR PRODUCTS & SEASONAL SUBSTITUTIONS

We make every effort to present our products accurately. Because flowers are seasonal and availability varies, substitutions of equal or greater value may be made for blooms, greenery, containers, ribbons, or accent items to maintain the overall look and value of your order. Colors and appearance can vary by device screen settings. We do not warrant that any item will meet your expectations or match photos exactly. Product descriptions and pricing may change without notice, and we may limit quantities by person, household, region, or order.

3. ORDERS

When you place an order, you make an offer to purchase. We may accept, decline, or cancel any order at our discretion (e.g., product availability, suspected fraud, incorrect information). Your order is accepted once we confirm and process payment. Please review your order carefully before submitting; changes or cancellations may not be possible after acceptance (see Section 8).

You represent that purchases are for personal or household use and not for resale.

4. PRICES, PROMOTIONS & BILLING

Prices, discounts, and promotions may change without notice. The price in effect at the time of purchase applies and will appear on your confirmation. Unless stated otherwise, prices exclude taxes, fees, shipping, and delivery charges. Online prices may differ from in-store or third-party listings. You agree to provide current, complete billing details and authorize us or our processor to charge your payment method for all amounts due, including applicable taxes and fees.

5. LOCAL DELIVERY, PICKUP & SHIPPING

  • Local Delivery: Delivery windows are estimates and not guaranteed. If the recipient is unavailable, we may leave the order in a safe place (weather permitting), with a neighbor/office, or attempt re-delivery. Additional fees may apply for re-delivery or address corrections.

  • Pickup: Orders not picked up on the scheduled date may be held briefly; perishables may not be refundable.

  • Shipping (if offered): Title and risk of loss pass to you upon transfer to the carrier. We are not responsible for carrier delays, customs processing, or events outside our control.

Special locations (hospitals, schools, gated communities, funeral homes, cemeteries) may require additional information and lead time. Please provide accurate recipient details, delivery instructions, and access information.

6. FRESH-FLOWER QUALITY & PERISHABLE GOODS

Fresh flowers are perishable and environmentally sensitive. We stand behind quality and handle products with care. To extend vase life, follow included care tips (fresh water, cool placement, away from direct sun/heat/vents). Due to the perishable nature of flowers, returns are not accepted. If there is a quality issue, contact us within 24 hours of delivery with your order number and photos so we can assist.

7. SILK & GIFT ITEMS

Silk/faux designs and gift items may have different return eligibility than fresh flowers. If a return is permitted, items must be unused and in original condition/packaging within the stated window (if any). Custom or personalized items are typically non-returnable.

8. CANCELLATIONS, CHANGES & HOLIDAY ORDERS

Order changes or cancellations must be requested before design and processing begins. During peak periods (e.g., Valentine’s Day, Mother’s Day, Thanksgiving, Christmas, Homecoming/Prom weeks), changes/cancellations may not be possible once submitted. If we approve a cancellation, refunds may exclude irreversible processing or special-order costs.

9. EVENT & WEDDING ORDERS (IF APPLICABLE)

Event orders may require a contract, deposit, and final payment by specific dates. Substitution standards and force-majeure terms apply. Venue restrictions and delivery windows should be confirmed in advance.

10. INTELLECTUAL PROPERTY

All trademarks, logos, designs, photos, text, graphics, and other content in the Services are owned by Anna’s Floral Designs or its licensors and protected by intellectual-property laws. You may use the Services for personal, non-commercial purposes only. No content may be copied, reproduced, modified, or distributed without prior written consent.

11. OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools or link to third-party sites. Such tools and sites are provided “as is” and “as available” without warranties. Your use of third-party tools/sites is at your own risk and subject to their terms and privacy policies.

12. RELATIONSHIP WITH SHOPIFY

Anna’s Floral Designs is powered by Shopify, which enables us to provide the Services. However, all sales are made directly with Anna’s Floral Designs. By using the Services, you acknowledge and agree that Shopify is not responsible for any sales between you and Anna’s Floral Designs, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Anna’s Floral Designs.

13. PRIVACY

Your use of the Services is subject to our Privacy Policy and Shopify’s privacy practices. Information you submit may be processed by Shopify and service partners (which may be located outside your country) to operate and improve the Services.

14. REVIEWS & FEEDBACK

If you submit reviews, photos, or other content (“Feedback”), you grant us a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, publish, and display such Feedback for any purpose. You represent that you own or have rights to the Feedback and that it complies with law and these Terms. We may monitor, edit, or remove Feedback at our discretion.

15. ERRORS, INACCURACIES & OMISSIONS

From time to time, information on the Services may contain typographical errors, inaccuracies, or omissions (including product descriptions, pricing, availability, and transit times). We reserve the right to correct, update, or cancel orders affected by such issues at any time, including after submission.

16. PROHIBITED USES

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to engage in fraud, harassment, infringement, scraping, spamming, malware distribution, or any activity that interferes with or circumvents security features or the normal operation of the Services.

17. TERMINATION

We may suspend or terminate access to the Services at any time, with or without notice, including for violation of these Terms. Sections that by their nature should survive termination will survive.

18. DISCLAIMER OF WARRANTIES

Except as expressly stated by Anna’s Floral Designs, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, timely, secure, or error-free operation.

19. LIMITATION OF LIABILITY

To the fullest extent permitted by law, in no case shall Anna’s Floral Designs (or our owners, directors, employees, agents, service providers, or licensors) be liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits, arising from your use of the Services or products, even if advised of the possibility. Your exclusive remedy is to stop using the Services.

20. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Anna’s Floral Designs and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your violation of law, or your misuse of the Services.

21. SEVERABILITY

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

22. WAIVER & ENTIRE AGREEMENT

Our failure to enforce any right does not constitute a waiver. These Terms, together with posted policies (including the Privacy Policy and any Delivery/Refund policies), constitute the entire agreement between you and us and supersede prior understandings.

23. ASSIGNMENT

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer our rights and obligations without notice.

24. GOVERNING LAW

These Terms and any disputes will be governed by the laws of the State of Louisiana, without regard to conflict-of-laws rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Louisiana for resolution of any dispute.

25. CHANGES TO TERMS

You can review the most current version of these Terms at any time on this page. We may update these Terms by posting changes. Where required by law, we will provide notice of material changes. Your continued use of the Services after changes are posted constitutes acceptance.
